Terms and Conditions of Rental - Centro Ortopédico do Sul - Online
1. Object of the Rental Agreement
Rentals from Centro Ortopédico do Sul are for the rental of orthopedic and mobility equipment, including, but not limited to, wheelchairs, adjustable beds, walkers, and others.
When using our services, you agree to the terms set out below. These terms govern the rental of orthopedic and mobility equipment through our website.
2. Rental and Deposit
At the beginning of the rental process, the client must pay the price of the item, plus the deposit amount, using the following payment methods:
• Cash
• Credit Card
• Cheque issued to Centro Ortopédico do Sul, Lda.
• Bank Transfer to IBAN: PT50003300000004657300584 (SWIFT CODE: BCPPTPL)
2.1 Deposit
2.2 Deposit paid in cash or cheque: Before collecting the equipment, the client must provide a deposit. The deposit will be refunded to the client after the equipment is returned, provided it is in good condition, following an inspection by Centro Ortopédico do Sul.
2.3 Deposit Paid by Credit Card or Bank Transfer: When returning the equipment, after inspection, we will instruct our Finance Department to process the refund. This process may take up to 10 working days.
3. Duration of the Rental
The rental may be either monthly or weekly. If the client wishes to extend the rental period, they must agree with Centro Ortopédico do Sul in advance.
4. Delivery of the Equipment
The client must return the equipment to Centro Ortopédico do Sul on the last working day of the rental period, in the same condition as it was received, i.e., without damage, without personal items inside, and in perfect working condition. If the equipment is not returned on time, penalties may apply, as described in Clause 6.
5. Obligations of the Parties
5.1 The client agrees to use the equipment with care and maintain it in perfect condition during the rental period.5.2 The client may not use the equipment for purposes that are:
• Inconvenient, unhealthy, dangerous, or illegal.
• Likely to cause damage to other persons or property.
5.3 The client will be solely responsible for any damage caused to the equipment, whether by themselves or by any other person using the equipment with their authorization, exempting Centro Ortopédico do Sul from any liability.5.4 The client may not make modifications to the equipment, perform repairs, or add any inscriptions or markings without the written authorization of Centro Ortopédico do Sul.5.5 The client may not transfer the equipment to third parties, whether for free or for a fee, nor use it as collateral for any transaction or contract.
6. Penalty Clause
Failure to comply with the rental conditions, particularly the return of the equipment within the agreed timeframe, will result in the client being required to pay a penalty equivalent to three times the monthly rental value, charged for each week of delay, without prejudice to any additional expenses, including attorney and legal fees.
7. Amendments to the Terms
Centro Ortopédico do Sul reserves the right to change the rental terms and conditions at any time. These changes will take effect immediately after publication on the website, unless otherwise stated.
8. Privacy Policy
Centro Ortopédico do Sul is committed to protecting the privacy of its clients. All personal data provided will be processed according to our Privacy Policy, which can be reviewed here.
9. Client’s Responsibility
Centro Ortopédico do Sul commits to providing the equipment in perfect working condition and with adequate safety features. However, Centro Ortopédico do Sul will not be liable for any damage or injury caused by improper use of the equipment.
10. Applicable Law and Jurisdiction
These conditions are governed by Portuguese law. Any dispute arising from this contract will be resolved in the courts of the Algarve region, unless otherwise provided by law.
